Whilst I feel for "C" who is paying for this to go through the Court?

Surely if "C" has the money to pay for the High Court and Barristers then "C" would have the money to go private rather than taking the NHS to Court over this.

Does this therefore mean the tax payers are footing the bill for both "C" and the NHS to have this argument?

I think the answer is that we don't know from the article who is picking up the tab but I will be amazed if it is not the tax payer.

This might be a test case, which can attract legal aid, I understand.

So where does the legal aid money come from?

If you are a tax payer then it's you!

Odd isn't it, very few of those refused life saving drugs ever resort to litigation. Perhaps this does show we need far more money in our NHS - if only to treat our sick society.

I think it happens all the time. And not just against NICE, it is for alleged inadequate treatment in other areas as well. To be fair on the NHS, I think we need to re-design it, this includes giving the NHS 'some' room for error.

No, its simply down to priority and clarity. We have insufficient money to do everything - most people see that. The NHS was put in place to help eliminate one of five 'Giant Evils' that of disease. I'm sorry but the plantiffs claim in this case is not about curing a disease. That is of course, without any sophisticated spin on the word disease.

If you were burned badly, you would expect to be able to say to the NHS that you needed help and surgery in order to go head and lead a normal life and reduce all the people pointing at you and improve your confidence. If you then fancied some bigger tits, it would hold the same values - in my opinion none.

Well, it looks like we agree on something. wink.gif
I believe that reviving the NHS is a very compliated procedure. I am not convinced that it needs more money raather a better distribution of finds with published realistic outcomes. I believe the publics expectations may be too high.
There is so much money wasted in dealing with drunks, unnecesssary procedures, trivial and imagined illnesses and of course a huge and unwieldy management structure.
Maybe a new government will start the process.

I think the difference between lifestyle choices and illnesses needs to made clear here.

Obviously if one contracts an illness or an injury through accident then it should be treated on the NHS no question.

If a person chooses to have breasts added or enlarged or to take recreational drugs should the same apply?

Personally I think not.
Your choice - you pay.

I don't think it is as cut a dry as that, although it is an option. People don't usually chose to be transgender.

You'd think, reading some of these posts, that the general concensus was that this person woke up one morning & decided they wanted to be a woman. With big breasts.

It is not so much the cost of the opertion but the cost of the litigation that is going on that is worrying to me. I know the NHS probably have to defend this claim so that they are not bombarded with similar requests which they would not be able to refuse. I am sure that "C" will probably win on the grounds of mental cruelty or such like. Quite right that "C" has not chosen to be this way but that does not mean we have to pay for it. I would like to have smaller breasts but I am sure if I went to ask my GP I would be refused because they are not causing me health problems - apart from severe backache !!!!! mellow.gif

I want to be better looking with more hair and other bits changed / enlarged.

I don't expect the taxpayer to contribute!

That isn't the point. Vanity is only a part of the issue.
