It could equally be said that it is a common 'trick' (hate that term but it's been used so I'll go with it) of proponents of the death penalty to say "well that's the old system, of course the new one would be better". Um, how exactly? The penalty is a consequence of a trial and conviction which, being part of the British justice system is not 100%. Safeguards are never completely safe.
